Counter suit filed in wrongful termination case

A wrongful termination suit can be controversial and in the case of a woman who alleges she was wrongfully terminated, is now facing a counterclaim on her suit from the daycare where she previously worked.

Kiddie Korner Day Care in Texas is filing their counterclaim because they feel the former employee is making false accusations against their company and is slandering the business. The original wrongful termination suit began last year when an employee of the daycare reported a possible case of child abuse or neglect with the Jefferson County Sheriff’s Department.

When questioned by the daycare, the woman admitted to making the report and was immediately fired by the daycare’s administrator. In the woman’s wrongful termination suit, she is claiming that she was discriminated against and wrongfully terminated under the Texas Family Code. She is suing for punitive damages, lost wages and mental anguish.

Now, Kiddie Korner is alleging that the former employee is making slanderous comments to other area businesses about the daycare and contacted the state inspector to report a false rat and roach infestation. In the counterclaim, the daycare feels that the negative comments have caused their business embarrassment, mental anguish and loss of profits.

This case is far from over with both sides accusing the other of wrong doing.
