Disability retirement benefits for federal employees

A disability can be a very difficult thing to live with.

While the physical challenges of a disability are difficult on their own, people with disabilities often face financial difficulties as well.

For federal workers who living with a disability, there is promising news: Disability retirement benefits may be available through the Federal Employees Retirement System (FERS) or the Civil Service Retirement System (CSRS).

But it is important to know that not all claims are approved the first time around. If you are considering applying, there are a few things you should know.

Am I eligible for disability retirement?

If you are seeking retirement benefits through the Office of Personnel Management (OPM), you must meet certain qualifications:

  • You must have held your federal job for at least 18 months
  • You must be suffering from a disability that is expected to last for a period of one year or longer
  • Your disability must prevent you from performing your job duties
  • There must be no other alternative jobs available that you could perform

If you have questions about these requirements, talk to an attorney. It is important to be fully informed as you enter into this process and prepare your application.

What happens if my claim is denied?

If the OPM denies your claim, do not panic. You can seek an appeal by requesting a reconsideration by the OPM.

If the OPM denies your claim in reconsideration, you can seek an appeal through the Merit Systems Protection Board (MSPB).

Remember: An attorney can help you through the appeals process. As soon as you learn that your claim has been denied, schedule a time to meet with an attorney from The Devadoss Law Firm, P.L.L.C.
