OPM Disability Retirement

If you are a federal employee who is suffering from a disability that prevents you from performing your job duties, you may be eligible for retirement under the Federal Employees Retirement System (FERS) or the Civil Service Retirement System (CSRS). An initial application must be filed with the Office of Personnel Management (OPM) in order to receive disability benefits. If your initial application is denied, it is possible to appeal the decision.

At The Devadoss Law Firm, P.L.L.C., our lawyers are committed to helping all federal employees secure the benefits and disability coverage to which they are entitled. If a disability has left you unable to work, contact us online or call to schedule a free initial consultation to discuss your case.

What Are The Eligibility Rules For OPM Disability Retirement?

Certain requirements must be met in order for a federal employee to be eligible for disability retirement, including:

  • Holding a federal position for at least 18 months
  • Suffering from a disability or illness that will last for at least one year
  • Inability to perform the essential functions of the job
  • No other job positions available that you can perform

It is important to note that an injury, disability, disease or illness does not have to occur at work or during the course of your job duties in order to qualify for disability retirement. Our attorneys can let you know whether you have a strong case and what your options may be.

Appealing A Disability Retirement Claim Denial

If the OPM denies your initial application for disability retirement, there are still options available. We can help you request a reconsideration from the OPM of your initial claim. If, after reconsideration, the OPM still denies your claim, an appeal may be made to the Merit Systems Protection Board (MSPB). We can help guide you through the initial application process and handle matters related to your appeal, if necessary. In every case, we will work hard to protect your interests.
